Smbhav Awards T&Cs
By participating in the Amazon Smbhav Awards 2024 contest ("Contest"), you signify your agreement or agreement of the business you represent, to be bound by these T&Cs and these T&Cs is an agreement between you or the business you represent ("you" or "your" or "Applicant") and Amazon Seller Services Private Limited ("we", "us", "our", and "Amazon"). If you are an individual representing a business or entity, you hereby represent and warrant that you are the duly authorized representative of the Applicant and have the full authority to submit the Nomination on behalf of the Applicant for participation in the Contest and bind the Applicant to these T&Cs.
1. ELIGIBILITY
1.1 To enter the Contest, the Nominations (defined below) must fulfil the eligibility criteria that has been provided under Annexure A to these Contest T&Cs.
2. DETAILS OF THE CONTEST AND HOW TO ENTER:
2.1 The Contest is an initiative of Amazon. All proprietary rights including intellectual property rights in connection with the Contest lie with Amazon.
2.2 Nomination: You can enter the Contest by filling and submitting the nomination form ("Nomination") hosted on the website at smbhav.amazon.in (smbhav2024.com) ("Site").
2.3 Nomination for the Contest shall be submitted by Applicants eligible to enter the Contest, through their duly authorized representatives.
2.4 Applicants shall submit the details for Nomination and participation as may be required by Amazon from time to time including but not limited to – business details such as year of incorporation, nature of business, revenue and related financial details for up to four years, Applicant’s / authorized person's details such as name, email id and mobile number. Failure to comply will lead to the Nomination being disqualified.
2.5 By agreeing to participate and enter the Contest, Applicants agree that they have relevant documents to validate the eligibility requirements for this Contest, and Applicants may be required to share the said documents with Amazon as and when requested, including by way of the Nomination form.
2.6 All Nominations to the Contest must be submitted on the Site before midnight of –28th November, 2024.
2.7 Entry to the Contest does not require any fees.
2.8 Applicants can submit their Nomination for any category of the Contest for which they are eligible.
2.9 By submitting the Nomination you are not guaranteed to receive any Awards.
3. AWARDS
3.1 Subject to fulfillment of these T&Cs, the below "Award(s)" will be provided, to winners as provided below:
(a) Award: Trophy
(b) Number of Awards in each category (as mentioned under Annexure A): 1
(c) Number of Winners in each category (as mentioned under Annexure A): 1
4. AWARD DRAWING:
4.1 Evaluation of Nominations will be undertaken by PricewaterhouseCoopers Private Limited ("PwC") in consultation with Amazon. Such evaluation will be done in a fair, reasonable and non- discriminatory manner and as per the broad evaluation criteria mentioned under Annexure B to these Contest T&Cs. Amazon and PwC also reserve the right to determine winners based on other relevant criteria.
4.2 The selection of winners of the Awards will be done by a jury consisting of: (a) person(s) with relevant industry knowledge; and (b) Amazon personnel (collectively, "Jury"). The decision of the Jury shall be final and binding in all matters relating to determination of the winners and the awarding of Awards. No appeals or further correspondence will be entertained.
4.3 Amazon will notify the Applicants that meet the requirements to claim the Award, by e-mail / SMS by December 9th, 2024 ("Notification Date"). The Award(s) will be distributed on December 10, 2024 at Amazon Smbhav 2024 proposed to be held at Bharat Mandapam, New Delhi ("Event"). The Applicant will be required to attend the Event. In case the Applicant is unable to attend the Event, Amazon may, at its sole discretion, send the Award to your contact details submitted during Nomination.
4.4 You will automatically forfeit your claim to the Award(s) if you do not meet the eligibility or do not comply with these T&Cs. Further, if selected and eligible, you will need to claim the Award(s) within 10 (ten) days from the Notification Date, failing which, you will deem to have forfeited the Award(s). The procedure of claiming the Award(s) will be as instructed by Amazon, wherein you may be required to visit appropriate web-links and provide requisite details. Each Award(s) will be awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
5. MAILING LIST:
By entering the Contest, you consent to being placed on a mailing list for promotional and other materials for Amazon. You may update or change your email preferences at the email preferences page.
6. OTHER CONTESTS/ AWARDS:
Please note that we may be running similar contests or promotions at the same time as these Contests. By entering the Contest, you will not be eligible to receive any benefit and/ or prize awarded in any other promotion/ contest unless you enter each promotion/ contest separately.
7. OTHER TERMS & CONDITIONS
7.1 All applications must be true and correct along with updated business details and must fulfill the eligibility criteria mentioned in these T&Cs.
7.2 The Applicant agrees to be bound by the evaluation, determination and decisions of the evaluators including PWC, the Jury and the Jury as to the evaluation of Nominations including eligibility to participate in the Contest, determination of the winners and the awarding of Awards shall be final. No correspondence, telephone, email or communication of any kind will be entertained in relation to the decision of the Jury or evaluators and the same shall be final and binding.
7.3 All material submitted in support of application is warranted by the Applicant to be their property and is without any encumbrances by third parties including any misappropriation or infringement of third party intellectual property rights of any third party, and they have the requisite rights, authorities and licenses to share the same for the Contest.
7.4 The Contest is designed by Amazon in association with PwC and is per their best of efforts.
7.5 Amazon does not make any commitment, express or implied to respond to any feedback, suggestion and/or queries of the users or Applicants and Amazon disclaims all warranties, whether express or implied, in relation to the Contest and the Awards.
7.6 The Applicant agrees that the Jury is entitled to judge the Nominations and select winner(s) as per their discretion without recourse to the Applicant.
7.7 If the Applicant gets shortlisted for the Awards or gets selected as a winner, the Applicant grants permission to Amazon to use any material and details shared by the Applicant including but not limited to photographs, video, audio files, written or other material as may be deemed fit by Amazon and without restriction. The Applicant hereby grants (a) Amazon and its affiliates, the worldwide, exclusive, perpetual, sub-licensable, assignable, royalty-free, rights and license, to take, use, display, edit, distribute, modify, make derivative works, and publish the materials submitted as part of the Nominations or otherwise provided to Amazon (collectively, the "Materials") in any form, format and manner, and in any media whatsoever, for any purpose; (b) grants consent to Amazon, its affiliates, its agents, its contractors, and its service providers to collect, store, analyze, process, and use the Materials; (C) releases Amazon from all claims and liability relating to the Materials.
7.8 Nominations received without the mandatory fields filled will be deemed invalid and withdrawn from the Contest without any intimation.
7.9 The authorized representative or the point of contact named on the Nomination will be deemed as the point of contact by Amazon.
7.10 Nomination deadlines and other timelines may be extended at the discretion of Amazon without assigning any reasons.
7.11 Applicants agree to be contacted by Amazon and its partners, representatives or service providers etc for the purposes of communication (via email, phone or post).
7.12 All Nominations will be judged on the information or details provided at the time of Nominations. Any amendments may be accepted up till the form is submitted, after which no further amendments will be accepted. Amazon reserves the right to require any other additional information that it may require for the purposes of evaluation.
7.13 These terms shall at all times be read in conjunction with Terms of use (available here) and Privacy policy (available here).
8. DISCLAIMERS & LIMITATION OF LIABILITY
8.1 This Contest is being made purely on a "best effort" basis and participating in this Contest is voluntary. By entering this Contest, (a) the Applicant agrees to be bound by the T&Cs; and (b) the Applicant and the business they represent release from liability, indemnify, defend and hold harmless Amazon, and any of its affiliates, employees, partners and agents representing or related to Amazon and its services/products. This release is for any and all claims, expenses and liability (including reasonable attorneys' fees), including but not limited to damages of any kind, defamation, negligence, infringement of trademark, copyright or other intellectual property rights, personal injuries, property loss or damage, and misuse of the benefits/ Awards offered under this Contest, in connection with any activity or directly or indirectly, by reason of the acceptance, possession, or participation in this Contest, even if caused or contributed to by Amazon's negligence.
8.2 Amazon is not liable for any damages (including direct, indirect, consequential, incidental and exemplary) in the event that the Contest (registration and/or participation thereof) is unavailable/inaccessible to Applicants (by virtue of interruption, suspension or termination) for any reason, including due to computer or communications link downtime attributable to malfunction, upgrades or preventative or remedial maintenance activities.
8.3 Notwithstanding anything to the contrary, Amazon shall not be liable to the Applicants, the business they represent or any third party, in any manner whatsoever in connection with the Contest.
9. MISCELLANEOUS
Amazon may, in its sole discretion and at any time, disqualify any Applicant if: (a) found to be in non-compliance with the T&Cs; (b) found to be tampering with the entry process, the outcome of this Contest, or the operation of this Contest; (c) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other Applicant; (d) in violation of any applicable law. By participating in this Contest, each Applicant unconditionally accepts and agrees to comply with and abide by the T&Cs and the decisions of Amazon, which will be final and binding, including Amazon’s right to verify eligibility, to interpret the T&Cs, and to resolve any disputes relating to this Contest at any time. Failure by Amazon to enforce any of these T&Cs in any instance shall not be deemed to be a waiver of the T&Cs and shall not give rise to any claim by any person. These T&Cs are governed by the laws of India and courts at Bangalore shall have the exclusive jurisdiction in respect of any disputes or any matter arising here from.
10. FORCE MAJEURE:
This Contest is subject to force majeure circumstances including without limitation, floods, natural disasters, war, act of terror, political unrests, technical snags, governmental restrictions, act of God or any circumstance beyond the reasonable control of Amazon ("Force Majeure Event"). Amazon shall not be liable for any delay or adverse effect caused to you as a result of a Force Majeure Event.

12.1. You confirm your understanding and consent to Amazon for sharing your personal data including without limitation your name, business address and other details with PwC for the purpose of participation in contest ("Contest") for Amazon Smbhav Awards, 2024. The information provided by you in this nomination form to Amazon, will be treated in accordance with the privacy notice (available here).
12.2. Amazon collects personal information about the Applicant when they enter the Contest. The Applicant submitting such information specifically consent to Amazon sharing any and/or all information with third party assessment service providers including PwC at its sole discretion for the purposes of assessment and for the purposes in connection with the Contest and these T&Cs. The Applicant also consents to receiving promotional or marketing communications from Amazon or its affiliates,
12.3. The Applicant agrees that Amazon may collect, process, use their personal information and other details provided by Applicant for the Contest for the purposes of collecting, analyzing, collating, using and otherwise storing the data provided by Applicant for as long as is necessary for the purpose of the Contest and the Awards and the Applicant specifically consents to the same. Further, Amazon and its partners may contact the Applicant or send reminders to the Applicant for the purposes of completion of registration formalities or for providing additional information and the applicant provides its consent for the same. The Applicant may also receive periodic communications relating to future competitions or otherwise from Amazon. By registering for this Contest, you agree and acknowledge that they may be contacted by Amazon of any of its affiliates via email, SMS, and phone You further agree and acknowledge that such communication shall not be considered to be unsolicited commercial email or spam. It is the sole responsibility of the Applicant to notify Amazon in writing, should the Applicant’s email address change.
